Human Rights Watch has accused Japan’s 1948 Flag Desecration Law of violating constitutional free‑speech guarantees. The law criminalises any public act that “defiles” the national flag, a measure critics say suppresses dissent and targets protest movements. HRW argues that the statute is overly broad, criminalising legitimate political expression and stifling democratic debate.

The report highlights how the law is used to intimidate activists, journalists and students who challenge state narratives. By labeling dissent as “defamation of the flag,” authorities can impose fines and prison terms, effectively silencing opposition voices.

HRW calls for immediate repeal of the law and the establishment of a transparent, independent review process to protect both national symbols and fundamental civil liberties. The organization stresses that accountability and truth must guide Japan’s legal reforms.
